The HCSCC NT is an independent statutory body established by the Health and Community Services Complaints Act 1998 (the Act) and the Health and Community Services Complaints Regulations 1998. The Act sets out the powers and functions of the Commissioner.
The Code of Health and Community Services Rights and Responsibilities
The Code of Health and Community Services Rights and Responsibilities sets out the rights and responsibilities of service users and service providers in health, disability and aged care services throughout the Territory. It was approved by the Minister for Health and Community Services in April 2002.
National Registration of health practitioners
On 1 July 2010 the Health Practitioner Regulation National Law Act 2009 (National Law) established a national system for the regulation of health professions and the Australian Health Practitioner Regulation Agency (Ahpra). Ahpra is the administrative body responsible for administering 15 national registration boards.
The scheme was established in the NT by the Health Practitioner Regulation (National Uniform Legislation) Act 2010.

Carers Recognition Act 2006
When assessing the reasonableness of a provider’s actions, the Commissioner must take into account the eight principles of the Carers Charter which are set out in the Schedule to the Carers Recognition Act 2006. These principles require that Carers should be treated with respect and included in treatment.
